Tilbury wins IR35 appeal against the Revenue

UKTECH has just heard that Roger Tilbury and his company Tilbury Consulting have won their appeal at the Special Commissioners against the Revenue (represented by Peter Death) who were claiming that he was a disguised employee of his client.

Accountax who represented Mr Tilbury at the hearing are not yet able to give details of the decision but confirmed that the Special Commissioner has ruled in favour of the freelancer and his company.

We will have to wait for more details to be available in order to assess the significance of the decision and see whether it raises issues that can be applied to other cases or whether it is very much dependent on its quite unusual circumstances.

It seemed highly unlikely that Roger Tilbury would lose based on the case that Dave Smith of Accountax had so carefully laid before the Commissioner. Nevertheless it comes as a relief to know that the Commissioners agreed with my view of the case having sat through the two days of the hearing.
