IR35 rules leave clients open to demands for employee benefits
Effectively, all that the new documentation indicates is how IR officials can deem you as within IR35.
I made a comment some weeks back that the government should simply adopt this approach for SPCs:-
IF TRUE GOSUB GREEDY_CONTRACTOR
That is all they are interested in at the end of the day, as well as:
IF EDS = TRUE
OR ANDERSENS = TRUE
OR TARTAR = TRUE
OR MATRIX = TRUE
OR INLIST(ANY, NL, BIG, CONTRIBUTOR) = TRUE
GOSUB GIVE_TAX_BREAK
I find it extraordinary that the IR has left themselves wide open for those who fall within IR35 to legitimately go to their current client and demand employee's benefits. If clients previously thought that this would not affect them - then think again.
Perhaps it's time for client sites to now voice their opinion with regards to IR35 (I've not heard much in the way of large client bases voicing out against IR35).
I wonder how long it will be before there is an amendment to the literature in order to rectify this - in the government's favour of course.
