New starter asks whether to go sole trader or limited under IR35
HI
I need to have some clear advice. I just don't see what I should.
I'm just starting out and am getting a few days here and there from an old colleague. I intend to work this way rather than signing a fixed term contract with an agency but may resort to that if work doesn't take off. I was all set to set up a limited so I could invoice for work done for the colleague and a company that gave me a week's work, I did look into umbrella companies but after a few calls to IT focused accountants a limited company seemed to be the way to go. Then one accountant said that due to IR35 if at all possible try acting as a sole trader rather than starting a company. I contacted my 2 clients and they are happy to be invoiced by a sole trader "my name, network consultancy". But I'm a bit concerned as to the implications of working in this manner and I can't seem to get a clear answer as to what's the best route to go. Also, I was made redundant in Jan and am concerned that as I've not registered unemployed (pride) the TAX man may not believe that I have currently only done 8 days work since then and as of yet not invoiced for any money! in fact I'm out of pocket due to expenses.
Any ideas, advice or suggestions anyone please. I want to do this right and be legal etc.
